Texas Communications Acceptable Use Policy

This Acceptable Use Policy defines the actions which Leapfrog Technologies, the parent company of BitStreet Internet®, considers to be abusive and, therefore, strictly prohibited.

  • Multiple logins, including the use of an account by two or more people simultaneously, are prohibited except as allowed by written agreement. Violation of this will result in the assessment of additional charges to the account holders account. Additional charges may be charged against the account holders standard method of payment without prior notice.
  • Attempts to circumvent connect time charges are prohibited.
  • Login sessions on Leapfrog systems, including dialup and ISDN connections, are subject to idle time-outs. A login session is considered idle if there is no interactive, human generated data received from the subscribers computer within a defined length of time. Idle login sessions may be disconnected.
  • Automated data is data that is generated on a subscriber's computer automatically by an automated program, script, automated redialer, or other software or hardware device. Automated data of any kind is not considered interactive use and will be considered a candidate for idle time-out. Intentional use of automated data to avoid idle time-outs is prohibited and may, at Leapfrog's sole discretion, result in account termination. This includes the use of automatic redialers to reinstate an idle connection as well as any program which directly or indirectly causes a non-interactive login session to be maintained.
  • Dialup sessions may not be used to feed a Local Area Network (LAN) or any other type of network with IP data except as allowed by written agreement.
  • Subscribers may not provide network services such as IRC and MUD servers from dialup accounts.
    All connections to Leapfrog systems may be logged for security and accounting purposes.

USER WEB PAGES
Any user web pages which, in Leapfrog's opinion, contain objectionable material may be removed from user web server index pages or the server.

EMAIL

  • Subscribers may not send email to any person who does not wish to receive it. If the recipient asks to stop receiving email, the subscriber must stop sending email to that person.
  • Harassment through language, frequency, or size of messages is prohibited.
  • The transmission of unsolicited bulk mail messages ("junk mail" or "spam") is prohibited. This includes, but is not limited to, bulk mailing of commercial advertising, informational announcements, and political tracts.
  • Subscribers may not propagate or forward chain letters of any type regardless of whether or not a recipient wishes to receive such mailings.
  • Malicious email, including but not limited to, flooding a site or user with very large or numerous messages ("mailbombing") is prohibited.
  • Forging of header information is not permitted.

GENERAL

  • The examples cited below are provided as guidance to Leapfrog subscribers. If you are unsure whether a use or action is permitted, please send e-mail to policy@bitstreet.net and we will assist you.
  • Leapfrog services may only be used for lawful purposes. Transmission, distribution, or storage of any information, data, or material in violation of federal, state or local law is prohibited. This includes material protected by copyright, trademark, or any other statute. Also prohibited is transmission via Leapfrog's facilities of any material which is, in Leapfrog's discretion, unlawful, libelous, abusive, threatening, obscene, hateful, would encourage commission of a criminal offense, would give rise to civil liability, or would otherwise violate local, state, national, or international law. Leapfrog reserves the right to archive and/or delete any such materials from its servers.
  • Resale of Leapfrog products and services is not permitted unless specifically permitted by written agreement.
  • Billing information must be kept up-to-date. Furnishing false information or fraudulent use of credit card numbers is grounds for immediate termination and may subject the offender to civil and/or criminal liability.
  • All accounts which maintain a past due balance of 30 days or more are subject to cancellation without prior notice.

    Accounts paid by Credit Card or Bank Draft will be de-activated if payment for the account does not clear or if there is any problem in processing the payment. If payment is not received within five (5) days after de-activation, the account will be canceled.
  • Partial or prorated refunds are not available for canceled monthly accounts.
  • Subscribers may not attempt to circumvent authentication or security on any network, host, or account. This includes, but is not limited to, accessing data not intended for the subscriber, logging into a system where the subscriber is not expressly authorized, or probing the security of Leapfrog or other networks.
  • Interference with the service to any network, host, or user is prohibited. This includes, without limitation, "flooding", attempting to overload a service, attempting to "crash" a host, or any other "denial of service" attack.
  • Persons who violate system or network security may incur civil and/or criminal liability. Leapfrog will cooperate fully with investigations of violations of network or system security at other sites and will cooperate with law enforcement agencies in the investigation of suspected criminal violations.
  • Password security is the responsibility of the individual subscriber. Subscribers may not share passwords or accounts with others. The Personal Identification Number (PIN) for the account will be required in order to change passwords or to discuss account details with Technical Support.

DIALUP

  • Leapfrog dialup accounts are intended for interactive use by the subscriber and his or her immediate family only. In the case of business accounts, use is extended to authorized staff, management, and executives.
  • Subscribers are prohibited from posting or crossposting the same or similar messages to large numbers of newsgroups ("USENET spam") and are prohibited from posting chain letters of any kind.
  • Forging of header information including attempts to circumvent the approval process for moderated groups is prohibited.
  • Binary files may not be posted to newsgroups not specifically named for binary postings.
  • Subscribers are prohibited from canceling or superseding postings other than their own. This rule does not apply to official group moderators performing their duties.
  • Subscribers may not solicit e-mail for any address other than that of the subscriber's Leapfrog account with the intent to harass or collect replies after Leapfrog service has been terminated.
